Article II.33 – Point 3 - Protection of knowledge (Publication)

3. A contractor may publish or allow the publication of data, on whatever medium, concerning knowledge it owns provided that this does not affect the protection of that knowledge. The Commission and the other contractors shall be given 30 days prior written notice of any planned publication. If, before the end of this period, the Commission and/or the other contractors so request, a copy of this data shall be communicated to them within 30 days after receipt of such request. The Commission and the other contractors may object to the publication within 30 days after receipt of the data envisaged to be published, if they consider that the protection of their knowledge would be adversely affected by this publication. The planned publication shall be suspended until the end of this consultation period. In the absence of any objection within the above-mentioned period, it is deemed that the Commission and the other contractors agree.

The consortium agreement may specify the practical details of any such right to object.

2. EURISOL DS CONSORTIUM AGREEMENT PROVISIONS

Article 9.2. Publication

In accordance with the EC Contract, any proposed publication or communication in connection with Knowledge shall be submitted for the prior written consent of the Contractors and the Commission.

To this end, any proposed publication or communication (or a summary), shall be submitted to the Review Committee (RC).

A guideline for publication policy and related procedures shall be approved by the Steering Committee (SC).

The RC will decide on:

1. acceptance of the proposed publication/communication; or

2. a request for modifications, specifically if certain pieces of information contained in the proposed publication are likely to impair the industrial and commercial use of Knowledge; or

3. request that the publication or communication be postponed, for a maximum period of 18-months, if real and serious reasons require this, especially if the information contained in the proposed publication or communication should be the subject matter of industrial property protection.

The terms of the above paragraph may not however defeat the obligation for the scientists involved in the Project to produce their activity report to the research organisation to which they report;

All written or oral public disclosures concerning the Project shall expressly mention that the work has been carried out under the EURISOL DS Project.

3. REVIEW COMMITTEE:

The revision of the EURISOL DS publications will be done by a Review Committee composed of 3 members appointed by the SC. Two of them are designated by the SC Chair and the third belonging to the Management Board (MB), is proposed by the Project Leader (PL).

The RC is chaired by the MB representative.

All data/documentation, under EURISOL DS Responsibility, should be sent for the approval to the RC.

4. MANDATORY DECLARATION

All written or oral public disclosures concerning the Project shall expressly mention that the work has been carried out under the EURISOL DS Project

All the papers should acknowledge the EU funding along with the declaration that they reflect only the author’s view, to free the European Community from any liability about the information contained.

The following sentence should appear in any paper:

We acknowledge the financial support of the European Community under the FP6 “Research Infrastructure Action - Structuring the European Research Area” EURISOL DS Project Contract no. 515768 RIDS . The EC is not liable for any use that can be made on the information contained herein.

6. REVIEW PROCEDURES:

EURISOL DS/Internal Task Note:

Responsibility of the Authors, no review is required but only the approval by the Task Leader.

EURISOL DS Journal Article: the scientifically highest category of publication. The review is organized prior to the journal submission and includes a review of the author list and of the scientific content of the paper. The peer review is done by the Review Committee.

EURISOL DS CONFERENCE Abstract/Proceeding:

Abstracts and the papers must be approved by the Review Committee before their respective submission deadlines.

EURISOL DS Reports: EURISOL DS Reports prepared by MB and approved by the SC.
